Pelaporan memburukkan lagi penderitaan mangsa penderaan kanak-kanak Jepun

Kira-kira 39 peratus daripada mangsa penderaan seksual di Jepun telah mengalami lebih banyak penderitaan semasa zaman kanak-kanak selepas melaporkan dan mendapatkan bantuan daripada orang lain, kata laporan tinjauan.

Kira-kira 218 daripada 683 mangsa penderaan yang ditinjau oleh kumpulan sokongan yang berpangkalan di Tokyo, Onara, berkata mereka merujuk pihak ketiga untuk mendapatkan bantuan dan 63.3 peratus tidak menerima respons positif, lapor Mainichi pada 21 Nov.

Sebanyak 39 peratus lagi menjawab bahawa penderaan itu menjadi lebih teruk, manakala hanya 6.9 peratus menjawab bahawa keadaan bertambah baik dan 6.4 peratus berkata mereka menerima perlindungan sementara, laporan itu menyatakan.

Kumpulan itu berkongsi butiran tinjauan dalam talian yang dijalankan pada September di kalangan mangsa penderaan, kini berumur 18 tahun ke atas, semasa sidang akhbar pada 19 Nov. Responden termasuk 62 lelaki dan 589 wanita.

Ketua kumpulan itu Tsugumi Okazaki berkata bahawa penafian bantuan daripada orang dewasa kepada kanak-kanak yang menghadapi penderaan seksual boleh menyebabkan mereka trauma.

“Kanak-kanak yang didera mengalami trauma emosi, jadi apabila mereka meminta bantuan dan ditolak, mereka cenderung merasakan tiada siapa yang akan membantu mereka lagi,” kata Okazaki.

“Bagaimana orang dewasa di sekeliling mereka bertindak balas adalah sangat penting,” tambah Okazaki.

Karen Makishima, bekas Menteri Hal Ehwal Digital Jepun, Arisa Yamaguchi seorang pakar psikiatri kanak-kanak, dan Ami Takahashi pengarah pusat sokongan mangsa penderaan Yuzuriha menghadiri sidang akhbar itu.

Hasil tinjauan mendedahkan perubahan dalam situasi penyalahgunaan selepas melaporkan.

Penderaan meningkat selepas melaporkan

Takahashi menegaskan bahawa sesetengah mangsa mungkin menghadapi peningkatan penderaan selepas melaporkan kepada pihak ketiga yang mungkin mendedahkan butiran kepada pendera.

“Jika kanak-kanak bercakap dengan guru sekolah, ibu bapa mereka mungkin mengetahui dan penderaan itu boleh menjadi lebih teruk,” kata Takahashi.

Melalui soalan berbilang pilihan, tinjauan itu mendedahkan butiran orang yang telah diceritakan oleh mangsa penderaan tentang situasi mereka.

Kira-kira 54.1 peratus daripada responden mengatakan bahawa mereka telah melaporkan penderaan seksual kepada guru mereka.

Ini diikuti oleh saudara-mara (40.4 peratus responden), rakan-rakan (28.9 peratus), dan orang dewasa di kawasan kejiranan (22 peratus).

Tinjauan itu juga mendedahkan butiran institusi awam yang didekati mangsa untuk melaporkan penderaan.

Kira-kira 21.6 peratus responden berkata mereka telah bercakap dengan polis, 17.9 peratus berkata mereka telah mendapatkan bantuan daripada pusat perundingan kanak-kanak, dan 7.8 peratus berkata mereka meminta bantuan daripada pejabat kerajaan.

Perubahan dalam undang-undang lapuk

Pada bulan Jun, parlimen Jepun menggubal undang-undang untuk menjenayahkan perbuatan seksual tanpa persetujuan walaupun tanpa keganasan fizikal atau paksaan, lapor Kyodo News.

Salah satu perubahan utama adalah untuk meningkatkan umur persetujuan seksual daripada 13 kepada 16 yang kekal tidak berubah selama lebih satu abad dan merupakan antara yang paling rendah dalam kalangan negara maju.

Undang-undang yang dipinda itu juga menjenayahkan “upskirting” dan bentuk lain menangkap imej seksual orang tanpa persetujuan mereka.

Semakan itu juga bertujuan untuk menjelaskan dengan lebih baik keharaman kesalahan seksual tanpa persetujuan seperti rogol. Rogol telah dinamakan semula sebagai “hubungan seksual paksa” apabila Jepun menyemak semula Kanun Keseksaan pada 2017.

Menurut undang-undang yang disemak, perbuatan seksual yang dijalankan dalam situasi di mana seseorang mungkin bergelut untuk “membentuk, menyatakan atau memenuhi niat untuk menentang” juga akan dikenakan kemungkinan hukuman, lapor Kyodo News.

Contoh yang dinyatakan ialah situasi yang melibatkan serangan, mangsa berada di bawah pengaruh alkohol atau dadah, atau pelaku menyalahgunakan kuasa ekonomi atau sosial mereka.

Badan perundangan juga telah memanjangkan statut had untuk pendakwaan persetubuhan tanpa persetujuan kepada 15 tahun daripada 10 tahun.

Semakan undang-undang terkini mengatakan jika mangsa berumur di bawah 18 tahun, statut pengehadan tidak akan bermula sehingga mangsa mencapai umur 18 tahun; umur dewasa yang sah.
